Terms of Service

These Terms of Service (“Terms”) govern your use of the Apex Auto Studios website at https://apexautostudios.com (the “Site”) and your engagement of services from Apex Auto Studios (“Apex,” “we,” “us,” or “our”). By using the Site or engaging our services, you agree to these Terms. If you do not agree, do not use the Site or engage our services.

1. About Apex Auto Studios

Apex Auto Studios is an automotive detailing and protection studio located in San Diego, California, providing services including ceramic coating, paint protection film (PPF), vinyl wraps, window tint, paint correction, and detailing.

2. Use of the Site

You may use the Site for lawful, personal, non-commercial purposes only. You agree not to:

  • Use the Site in any way that violates applicable law or regulation
  • Attempt to gain unauthorized access to any part of the Site or our systems
  • Interfere with or disrupt the operation of the Site
  • Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission
  • Submit false, misleading, or fraudulent information through forms on the Site
  • Use the Site to harass, threaten, or harm any person
  • Reproduce, distribute, or create derivative works from Site content without permission

3. Quotes, Estimates, and Service Engagement

Quotes are estimates, not contracts. Quotes provided through the Site, by phone, or via email are good-faith estimates based on the information you provide. Final pricing is determined after in-person inspection of your vehicle.

Estimate accuracy. In compliance with California Business and Professions Code § 9884.9, we will provide a written estimate before performing services that exceed $50. We will not exceed the written estimate by more than 10% without your authorization.

Booking confirmation. A service is not booked until we confirm in writing (email or text) and any required deposit is received.

Vehicle drop-off. You agree to remove all personal belongings from your vehicle before drop-off. Apex is not responsible for items left in the vehicle.

Authorization to perform work. By dropping off your vehicle and authorizing service, you authorize Apex to perform the agreed-upon work and operate your vehicle as necessary to complete that work.

4. Payment

Payment is due upon completion of service unless otherwise agreed in writing. Accepted payment methods include cash, credit/debit card, and other methods we may offer from time to time. A service charge of 1.5% per month (or the maximum allowed by law, whichever is lower) may apply to past-due balances.

5. Warranties and Disclaimers

Workmanship warranty. Apex stands behind the workmanship of our installations. Specific warranty terms depend on the service provided and the product manufacturer. Warranty terms will be provided in writing at the time of service.

Manufacturer warranties. Many products we install (ceramic coatings, paint protection film, window tint) come with manufacturer warranties. Manufacturer warranty claims are governed by the manufacturer’s terms, which we will provide upon request.

Limitations. Warranties do not cover:

  • Damage caused by accident, abuse, neglect, or improper care
  • Damage from automatic car washes (especially with brushes), abrasive cleaners, or unauthorized polishing
  • Pre-existing paint defects, rust, or corrosion not disclosed at intake
  • Damage from environmental factors beyond reasonable expectation (acts of God, vandalism)
  • Modifications or repairs performed by third parties after our service

Disclaimer. EXCEPT AS EXPRESSLY STATED IN A WRITTEN WARRANTY PROVIDED AT THE TIME OF SERVICE, ALL SERVICES AND PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APEX’S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR ANY SERVICE PROVIDED IS LIMITED TO THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. APEX SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF USE, OR LOSS OF DATA.

This limitation does not apply to liability that cannot be limited under California law, including liability for gross negligence, willful misconduct, fraud, or personal injury caused by Apex.

7. Indemnification

You agree to indemnify and hold harmless Apex, its owners, employees, and agents from any claims, damages, or expenses arising from:

  • Your breach of these Terms
  • Your misuse of the Site
  • False or misleading information you provide
  • Your violation of any applicable law

8. Intellectual Property

All content on the Site — including text, images, logos, graphics, videos, and design — is owned by Apex Auto Studios or licensed to us, and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from Site content without our written permission. Limited personal use (such as viewing, sharing links, or reasonable quotation for non-commercial purposes) is permitted.

The “Apex Auto Studios” name and logo are trademarks of Apex Auto Studios.

9. User-Submitted Content

If you submit content to us (photos of your vehicle, reviews, testimonials, social media tags), you grant Apex a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and business purposes, including on the Site, social media, and promotional materials.

You represent that you own or have the right to submit such content, and that the content does not infringe any third party’s rights.

If you do not want your vehicle photographed for marketing purposes, please notify us in writing at intake.

10. Third-Party Services and Links

The Site may include links to third-party websites or services (social media, payment processors, scheduling tools). We are not responsible for the content, policies, or practices of those third parties. Use them at your own risk.

11. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Modifications to These Terms

We may revise these Terms from time to time. Material changes will be communicated through a notice on the Site. The “Last Updated” date at the top reflects the most recent revision. Your continued use of the Site after changes take effect constitutes acceptance.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

14. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or any Apex service shall be resolved exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any written estimates or service agreements signed at intake, constitute the entire agreement between you and Apex regarding the Site and our services.

17. California Consumer Notices

Bureau of Automotive Repair. California’s Bureau of Automotive Repair (BAR) regulates certain automotive services. If our services fall within BAR’s jurisdiction and you have a complaint we cannot resolve, you may contact BAR at 1-800-952-5210 or bar.ca.gov.

Right to Inspect Work. You have the right to inspect work performed before final payment.

Estimate Accuracy. As stated in Section 3, we will not exceed written estimates by more than 10% without your authorization, in compliance with California Business and Professions Code § 9884.9.

Replaced Parts. If we replace any parts during service, you have the right to request return of the replaced parts at the time of service, except where parts must be returned to a manufacturer or distributor for warranty or core charge reasons.
